Axl Rose and Activision going to trial

from gamesindustry.biz ..................... $20 million lawsuit over Guitar Hero III: Legends of Rock

A judge has ruled that Gun N' Roses frontman Axl Rose can continue his breach-of-contract claim against Activision, with a lawsuit worth $20 million.

Rose alledges that Activision attained his permission to use the song Welcome To The Jungle in Guitar Hero III: Legends of Rock by deceiving him about the role Slash would play in the game. The two musicians have had a tempestuous relationship since Slash left the band in 1996.

Slash is a playable character in the game and features on the box art. But while the game came out October 2007, Rose didn't file his lawsuit until November 2010.

"The reason I did not file a lawsuit [in 2007] is because Activision - through my managers and representatives - offered me a separate video game and other business proposals worth millions of dollars to resolve and settle my claims relating to GHIII," said Rose in a deposition, published by Hollywood Reporter. .

"From December 2007 through November 2010, Activision was offering me a Guns N' Roses dedicated video game, a game dedicated to music from the Chinese Democracy album, and other proposals."

According to the rocker's lawyer, "Activision had been intentionally concealing its plans to use [Velvet Revolver] and Slash in the game all along."

There are also issues regarding the rights to the songs, which are held by GNR Music, and because it was an administrator, not a GNR Music employee, that signed the synch license.

Activision has defended its use of the song, and said "Rose had no authority to enter into a license for 'Welcome to the Jungle' in his individual capacity because he does not own the song or the sound recording."

The trial is scheduled for February 1 2013.

It's not the first trouble Activision has faced over its series of music games. Musicians from Maroon 5 , No Doubt have also taken legal action against the company, while former Nirvana band members Dave Grohl and Krist Novoselic admonished the publisher for its use of the late Kurt Cobain in Guitar Hero 5.

Cobain's ex-wife Courtney Love also threatened to sue "the **** out of Activision" over his appearance, but it later transpired she had signed the papers to allow use of his likeness.

I'm surprised he isn't pissed that he isn't a playable character (with wardrobe changes and stylist), seeing as he believes he is GnR.

The man is a giant fat ginger turd (always was).
He Headlined at Download (UK) in 2006 as GnR, and only stayed on stage for 50% of the gig, by playing every other song, between introducing an endless stream of guest (who the f*ck is that) friends.

All of GnR were there, but only came out one at a time !

He sat at a grand piano and played a jazz odyssey to an audience of open-mouthed confusion. Finishing it by proudly stating "Yeah that was great, that's going on the album"

He refused to come back on stage for the final song, until a roadie had found some carpet to nail to the front of the stage as he slipped/tripped or stumbled slightly.

During his farce of a set, he had requested all the security from the festival, were to form a human corridor back-stage, in-case he had to run to his helicopter and get away.
Because he was the headline act and would not play without protection, The festival sent as many of the security as they could spare.
This did not work so well as fires and fighting started to break out due to many areas now having no security.
The man is a coward and a self-indulgent scum-bag.

Happily for me (as a fan of actual real heavy-metal) walking through the crowd I got to witness 2 GnR fans hitting their t-shirts on the ground with sticks, and another take his off and set fire to it.
That sight alone made up for the crazy-show on-stage, and made my day

I am surprised he was not sued for putting thousands of peoples lives at risk.
I am surprised he has not been sued for impersonating GnR.

He will drag the GnR name down with him. I think the rest of the band should be the real GnR with a real singer with actual talent, and he can then be what he is... A tribute act.

If he wants his image everywhere, I am sure all the metal-heads in the UK could make their "Guy" for Guy Fawks night, look fat and ginger with an old rag on it's head.
Yeah I can see it now, an annual burning of the Axl. Could do a giant ginger blob for the burning man festival, stuffed full of the Axl bands t-shirts.

Prediction... he'll squeeze $ out of fans for 10 more years, then drug overdose when he realises it was all over in the 90's

Sadly he is probably immune and won't ever. We will be stuck with him until he is 90 years old and still the worlds biggest asshat.

I said it before and I will say it again; Why do people continue to go to his shows when they know that they are throwing their money away?

Is anyone "running a book" ?
I'd maybe go for good money on him choking on a burger, while on the toilet, whilst reading a bad review
